U.S. v. Ali Daniel Hemani

In a rare 9-0 decision the U.S. Supreme Court  decided that people who eat, smoke, or use marijuana and/or cannabis are still allowed to own their Firearm Owner’s Identification Card (FOID) and keep their firearm. Prior to this decision, marijuana users had their firearms taken away.

In United States vs. Hemani, decided this past June, 2026, the Supreme Court was asked to decide whether the Federal Gun Control Act, 18 U.S.C. 922 (g) et.seq., allowed the U.S. government to take your firearms if you used marijuana.  The Supreme Court correctly said “No. The government cannot take your firearms simply because you may use marijuana.

Government Arguments

The Court cited several reasons and precedent setting caselaw to make its decision. The government’s arguments centered on century-old historical analogies. The government used “habitually drunkard” laws from the 1800’s as their analogy for current marijuana use. The government failed miserably, as everyone knows, alcohol and marijuana are very different intoxicating compounds. Not analogous at all. Additionally, the government’s arguments failed in all aspects.

Facts of the Case

The facts of Hemani include that the government searched Hemani’s house as he was suspected of being a terrorist. The government found marijuana in his home, along with a lawfully owned firearm. Hemani cooperated with law enforcement and gave honest answers. The government took his firearm away from him and began a federal prosecution of him under the Federal Gun Control Act 922(g) et. seq. With a possible 15 year sentence. Hemani pushed back saying that the analogies that the government  used were not up to date with what was going on in today’s modern world. In the end, Hemani was right. The analogies used were not sufficient to prove that a drunk person was the same level as a casual marijuana user.

FOID Cards and Firearms for All

The Court noted that there might be a question as to how marijuana and its newly formed relationship with owning a FOID card or Concealed Carry Licensed (CCL). The United States has become more open-minded about people using marijuana, medicinally and recreationally. Cannabis has been rescheduled from a Schedule-1 drug to a Schedule-3. Marijuana is something that helps people, whereas alcohol is something that harms people.
